1. Scope and Provider

By using our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our services.

2. Description of Services

thailand.visaportal.com provides professional Thai visa advisory and consultancy services, including guidance on visa exemption, visa on arrival, eVisa, and other Thai visa types. Our services include, but are not limited to:

  • Guidance on visa requirements, eligibility, and immigration pathways
  • Advisory on the correct visa type for your travel purpose
  • Review and guidance on required documentation
  • Professional migration advice
  • Ongoing communication and follow-up regarding your enquiry

2.1 Important Disclaimer

thailand.visaportal.com is not a government authority and is not affiliated with any government or immigration agency. We are a private advisory service — we do not process or issue visas. The decision to grant or deny a visa lies solely with the relevant Thai government authorities. We do not guarantee the approval of any visa.

Our consultancy fee is separate from any government fees that may be applicable. Government fees, if applicable, will be communicated to you during the consultation.

3. Contract Formation

A contract between you (the "Client") and POWR GmbH is formed when:

  • You submit a contact form or otherwise request our services, and
  • We confirm acceptance of your request via email or other written communication.

The language of the contract is English or German, at the Client's preference.

4. Obligations of the Client

The Client agrees to:

  • Provide accurate, complete, and truthful information in all documents and forms
  • Respond to requests for additional information or documents in a timely manner
  • Inform us immediately of any changes to the provided information
  • Ensure that all passport and travel documents are valid for the required period
  • Pay the agreed consultancy fee in full and on time

We are not responsible for delays or rejections caused by inaccurate or incomplete information provided by the Client.

5. Fees and Payment

Our consultancy fees will be communicated to you before the commencement of our services. Payment is due upon confirmation of the order, unless otherwise agreed in writing.

Accepted payment methods will be communicated during the ordering process. All prices include the applicable statutory value-added tax (VAT) unless otherwise stated.

6. Liability

6.1 Limitation of Liability

POWR GmbH shall be liable without limitation for damages arising from injury to life, body, or health caused by a negligent or intentional breach of duty by us, our legal representatives, or our vicarious agents.

For other damages, our liability is limited as follows:

  • In cases of intentional or grossly negligent breaches of duty, we are liable without limitation.
  • In cases of slightly negligent breaches of material contractual obligations (obligations whose fulfilment is essential for the proper execution of the contract), our liability is limited to foreseeable, contract-typical damages.
  • We are not liable for slightly negligent breaches of non-material contractual obligations.

6.2 No Guarantee of Visa Approval

We expressly do not guarantee the approval of any visa. The decision to approve or deny a visa lies solely with the relevant Thai government authorities. Our service is limited to providing advisory and consultancy services. In the event of a visa rejection, the Client is not entitled to a refund of our consultancy fee, as the advisory service has been provided regardless of the outcome.

7. Right of Withdrawal

If you are a consumer within the meaning of § 13 BGB (German Civil Code), you have a statutory right of withdrawal. For full details, please refer to our Right of Withdrawal page.

8. Data Protection

We process your personal data in accordance with our Privacy Policy and in compliance with the EU General Data Protection Regulation (GDPR) and applicable German data protection laws.

9. Intellectual Property

All content on this website, including text, graphics, logos, icons, images, and software, is the property of POWR GmbH or its content suppliers and is protected by German and international copyright law. Unauthorised reproduction, distribution, or modification of any content is prohibited without our prior written consent.

10. Dispute Resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

11. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the Client is a consumer, the mandatory consumer protection provisions of the country in which the consumer has their habitual residence shall also apply, insofar as they are more favourable to the consumer.

For all disputes arising from or in connection with these Terms, the courts of Oldenburg, Germany, shall have jurisdiction, provided the Client is a merchant, a legal entity under public law, or a special fund under public law.

12. Severability

Should any provision of these Terms be or become invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the economic purpose of the invalid provision.

13. Amendments

We reserve the right to amend these Terms at any time. The amended Terms will be published on our website. By continuing to use our services after the publication of amended Terms, you agree to the amended Terms.
